TERMS AND CONDITIONS OF THE ONLINE STORE OF HERDADE DO ROCIM

  1. General Information

This document aims to regulate the terms and conditions governing the provision of the Online Store service of Rocim (www.rocim.pt) by Rocim, Lda., headquartered at Parque Movicortes 2404-006 Azoia, Leiria, with the corporate registration and tax identification number 502074400, with a share capital of €6,000,000.00, hereinafter referred to as “Rocim”.

Rocim reserves the right to freely change this pre-contractual information to comply with applicable legislation, without prior notice.

Navigating and purchasing any product on the website www.rocim.pt implies acceptance of this document.

Rocim maintains this website for individual use, in countries and territories where the consumption of alcoholic beverages is legal and for individuals legally permitted to consume alcoholic beverages.

  1. Product Information, Prices, and Content

2.1 Rocim reserves the right to modify, without prior notice and at any time, the information and commercial offers presented about: products, prices, promotions, commercial conditions, and services.

2.2 The images that illustrate each product on Rocim may differ from the product delivered later, and these products are also subject to stock unavailability.

2.3 If you purchase a product that differs from what was presented online, you have the right to resolve the purchase contract under applicable legal terms (Right of Free Resolution, see section 7).

2.4 Under Portuguese legislation, all prices presented on Rocim include the respective VAT taxes in effect unless otherwise indicated.

2.5 Promotions disclosed on Rocim may not be applicable to the physical store located at Herdade do Rocim, Estrada Nacional 387, 7940-909 Cuba.

  1. Responsibilities

3.1 All products sold in the Rocim Online Store comply with Portuguese law.

3.2 The online store has adequate security levels; however, Rocim is not responsible for any losses incurred by the user and/or third parties due to delays, interruptions, errors, and suspensions of communications originating from factors outside its control, including deficiencies or failures caused by the communications network, services provided by third parties, computer systems, modems, connection software, or any viruses or issues from downloading files infected with viruses or other properties that may affect the user’s equipment. If there is an access error to the website or an inability to provide the service, Rocim will not be responsible for any damages.

3.3 Rocim will not be responsible for any losses or damages caused by abusive use of the service not directly attributable to it by willful misconduct or gross negligence.

  1. User Obligations

4.1 The user agrees to:

i) Provide correct personal data and addresses; ii) Not use false identities.

4.2 If any data is incorrect or insufficient, causing a delay or failure in processing the order or delivery, the responsibility lies with the user, and Rocim disclaims any responsibility. If the user violates any of these obligations, Rocim reserves the right to cancel future purchases, block access to the store, cancel the provision of other services provided by Rocim to the same user, and prevent future access to any of Rocim’s services.

4.3 The use of products and services acquired for commercial purposes, including resale, is expressly prohibited.

  1. Privacy and Protection of Personal Data

5.1 Rocim guarantees the confidentiality of all data provided by users.

5.2 The data provided in the purchase form as mandatory is essential for the service provided by Rocim. Failure or incorrectness of the data provided by the user is the user’s sole responsibility and may result in the refusal of the service.

5.3 The user’s personal data will be processed and stored electronically for use by Rocim in the context of the contractual and/or commercial relationship with the user.

5.4 Under applicable legislation, users have the right to access, correct, and update their personal data, directly or by written request, as well as the right to oppose the use of such data for the purposes mentioned in the previous point. For this, users should contact the person responsible for data processing via the email herdadedorocim@herdadedorocim.com.

  1. Order Cancellation

6.1 At the user’s request: The user may cancel their order by contacting Rocim via phone or email (herdadedorocim@herdadedorocim.com), specifying the order number. This request will be accepted as long as the order has not been processed. After processing, Rocim will attempt to deliver the order, but the user has the option to refuse it.

6.2 By Rocim’s decision: Rocim reserves the right not to process orders if it detects inconsistencies in the personal data provided or observes misconduct by the user.

  1. Resolution and Return

7.1 Resolution The user has the right to resolve the contract without justification within 14 (fourteen) business days. This period begins the day after the user or a designated representative receives the product(s).

7.2 Return of Defective Products Rocim makes every effort to detect any defects in the products before dispatch. If a product is defective, the user should notify Rocim via email at herdadedorocim@herdadedorocim.com.

7.3 Conditions for product returns due to contract resolution or quality issues: The item must not have been used or altered. All original labels, packaging, and accessories must be included in the return.

7.4 – Alternative Dispute Resolution In case of a consumer dispute, the consumer may resort to the European Online Dispute Resolution Platform available at ec.europa.eu/consumers/odr.

  1. Intellectual Property

8.1 The Rocim website is registered, and the service provided by the website is the responsibility of Rocim.

8.2 The user acknowledges that the service contains confidential information protected by copyright and related rights, industrial property, and other applicable legislation.

  1. Suspension and Deactivation of Online Store Service

9.1 Rocim may, at any time and at its sole discretion, discontinue the service or part of the service for one or all users of the Rocim Online Store.

  1. Orders and Payment

10.1 – Prices All prices on the Rocim website are in euros (€), including VAT. However, the price does not include any shipping and handling fees.

10.2 – Price Changes Rocim reserves the right to change the prices of products on the website. However, during the order process and confirmation, the prices of products will remain unchanged.

10.3 – Payment Methods Payments can be made using Reference MB, MBway, or PayPal. Rocim ensures that all transactions are encrypted and 100% secure.

  1. Shipping and Delivery

11.1 The cost of shipping will be added to the value of the products. The user will be informed of the final price, including shipping costs, before completing the order.

  1. Shipping Costs and Delivery Times

12.1 For mainland Portugal only: Shipping is free for orders over €50. For orders of €50 or less, the shipping cost is a flat fee of €5.00.

12.2 Free Shipping: From time to time, certain campaigns may offer free shipping regardless of the delivery location or order value.

12.3 Important Information: Delivery times mentioned are indicative and may not account for delays due to payment authorization issues or carrier delays.

12.4 In case of delay in shipment, the user may request the cancellation of the order with a refund.

12.5 The user must provide the correct delivery address and can change the address before shipment.

12.6 In case of damaged packaging, the user must immediately file a complaint with the carrier and Rocim.

12.7 Orders not delivered due to user error will be returned to Rocim, with additional costs.

12.8 Rocim assumes responsibility for the order until it is delivered to the user.

12.9 Cases of force majeure, such as natural disasters or strikes, may affect the fulfillment of delivery deadlines.
